1. Introduction
Welcome to SimbaFit. These Terms and Conditions govern the use of our online coaching and virtual personal training services. By purchasing or using any of our services, you acknowledge that you have read, understood, and agreed to these terms. If you do not agree with any part of these terms, please do not use our services.

2. Services Provided
SimbaFit provides two primary services:

  • Online Coaching: Customized workout and nutrition programs designed and delivered through the ABC Trainerize app. Each program is personally created by SimbaFit and tailored to the client’s age, fitness level, gender, goals, available equipment, and schedule to maximize efficiency and results.

  • Virtual Personal Training: Live coaching sessions where SimbaFit guides clients through workouts via video call. These sessions are fully adapted to each individual, including those with injuries, restricted movement, or other physical limitations.

3. Eligibility

  • Clients must be 18 years or older or provide written parental consent to use our services.

  • To enroll in online coaching programs, clients must be in adequate physical condition to perform exercises independently without a coach present. If unsure, they should first book virtual training sessions to learn proper movement and form.

  • Clients of virtual personal training sessions may have any level of fitness, including injuries or restricted mobility, as SimbaFit will guide them through movements safely.

4. Payment and Pricing

  • All service prices are listed on the SimbaFit website. Any applicable taxes will be shown at checkout.

  • Payments must be made in advance for all coaching programs and virtual training sessions.

  • Failure to complete payment will result in no access to the program or scheduled training session.

5. Cancellation and Refund Policy

  • Clients must cancel or reschedule a training session at least 48 hours in advance. If canceled later than this, the session will be counted as completed and will not be refunded.

  • Training packages and coaching programs are non-refundable except in exceptional cases, such as a doctor’s note stating the client is completely ineligible for any type of physical exercise.

  • Programs and training sessions can always be adapted to various situations, including injuries or relocation, since they are conducted online.

6. Liability Disclaimer

  • Clients engage in SimbaFit’s services at their own risk.

  • While expert guidance and knowledge are provided, injuries can occur in training, whether alone or during virtual sessions. SimbaFit is not responsible for any injuries or health issues that arise.

  • Clients are advised to consult a doctor or healthcare professional before beginning any new fitness program, especially if they have pre-existing medical conditions.

7. Client Responsibilities

  • Clients must provide accurate health, fitness, and financial information when enrolling.

  • Clients should have a stable internet connection and a safe training space for virtual personal training sessions. The area must allow movement in all directions and be free of hazards.

  • Clients must follow the provided workout and nutrition plans responsibly and understand that results depend on their consistency and effort.

8. Intellectual Property

  • All training programs, materials, video content, and advice provided by SimbaFit are intellectual property and may not be copied, shared, or resold to third parties.

  • Any agreement between SimbaFit and a client is exclusive to both parties and non-transferable.

9. Modification of Terms

  • SimbaFit reserves the right to update or modify these Terms and Conditions at any time.

  • Clients will be informed of any changes and must accept the new terms to continue using our services.

10. Governing Law

  • These Terms and Conditions are governed by the laws of Germany.

  • Any disputes arising from these terms will be subject to the jurisdiction of German courts.
